Giving nisaab amount or more to a recipient of zakaat
Q: I need to pay zakaat. Can I purchase a flat and give my sister as she does not own a house and she is living on rent with not good income, even her husband is not earning enough?
A: The fuqahaa have mentioned that it is makrooh tahreemi (impermissible) to give the recipient the amount of nisaab or more, unless the recipient is a debtor in financial constraints and his debt is equal to the nisaab amount or more. Hence, to avoid this makrooh act, we advise that you purchase the flat for your sister after taking her consent. In this case, since your sister is the purchaser of the flat, she will be the debtor. Thereafter, you may pay off her debt with the zakaat money after taking her consent.
