When should the tasmee and tahmeed be recited?

Q: 

1. I am a student of deen. I wish to know whether the imaam and muqtadee should recite tahmeed in salaah? If they should recite it, then when should they recite it? Should they recite it while rising from ruku or while standing in qaumah? I have heard that there is a difference of opinion in the Hanafi Mazhab in regard to this mas’alah.

2. Should the munfarid recite tasmee and tahmeed or only tahmeed?

 

A: Before discussing the issue in question, it is vital for us to understand that in this mas’alah, there is a difference between the Mazhab of Imaam Abu Hanifah (rahimahullah) and his two respected students, Imaam Abu Yusuf and Imaam Muhammed (rahimahumallah).

 

The Mazhab of Imaam Abu Hanifah (rahimahullah)

The Mazhab of Imaam Abu Hanifah (rahimahullah) is that the imaam will only recite tasmee while rising from ruku, and the muqtadee will only recite tahmeed while rising from ruku. The imaam and muqtadee will both recite tasmee and tahmeed respectively at the same time and neither of them will recite anything in qaumah.

The proof of Imaam Abu Hanifah (rahimahullah) for the imaam only reciting tasmee and the muqtadi only reciting tahmeed is the Hadith of Rasulullah (sallallahu ‘alaihi wasallam):

إنما جعل الإمام ليؤتم به فلا تختلفوا عليه فإذا ركع فاركعوا وإذا قال سمع الله لمن حمده فقولوا ربنا لك الحمد (صحيح البخاري، الرقم: 722)

From this Hadith, we understand that both the imaam and the muqtadee have been given separate injunctions. The injunction of the imaam is to recite tasmee and the injunction of the muqtadee is to recite tahmeed.

The proof of Imaam Abu Hanifah (rahimahullah) for the imaam and muqtadee reciting tasmee and tahmeed respectively at the same time is that in all the postures of salaah, the muqtadee is commanded to  follow the imaam with muqaaranat (i.e. to commence the posture immediately when the imaam commences the posture and complete the posture with the imaam). Hence, the “فاء” which comes in the abovementioned Hadith:

فقولوا ربنا لك الحمد

refers to the muqtadee reciting the tahmeed immediately with the imaam. “فاء” coming in this meaning is also seen in other Ahaadith e.g.:

إنما جعل الإمام ليؤتم به فإذا كبر فكبروا وإذا ركع فاركعوا وإذا سجد فاسجدوا (صحيح البخاري، الرقم: 378)

Hence, when the imaam commences reciting tasmee, the muqtadee will also commence reciting tahmeed. He will not wait for the imaam to complete reciting tasmee before he will commence reciting tahmeed.


Why will the Imaam not recite Tahmeed?

According to Imaam Abu Hanifah (rahimahullah), there are two reasons for the imaam not reciting tahmeed in qaumah.

The first reason is that the Hadith “إذا قال الإمام سمع الله لمن حمده فقولوا ربنا لك الحمد” shows that both the imaam and muqtadee have been given separate injunctions. Hence, the imaam has not been given the injunction of reciting tahmeed.

The second reason for the imaam not reciting tahmeed is that if he recites tahmeed, his tahmeed will be recited in qaumah and it will thus take place after the tahmeed of the muqtadee which is incorrect (i.e. the muqtadee will recite the tahmeed while rising from ruku, and the imaam will recite it in qaumah, and it will be incorrect for the muqtadee to precede the imaam, therefore the imaam has not been commanded to recite the tahmeed).[1]

 

The Mazhab of Imaam Abu Yusuf (rahimahullah) and Imaam Muhammed (rahimahullah)

The mazhab of the two respected students of Imaam Abu Hanifah (rahimahullah), Imaam Abu Yusuf (rahimahullah) and Imaam Muhammed (rahimahullah), is that the imaam will recite both tasmee and tahmeed while the muqtadee will only recite tahmeed (this is also one view reported from Imaam Abu Hanifah (rahimahullah)). The imaam will recite tasmee while rising from ruku and he will thereafter recite tahmeed in the posture of qaumah.

As for the muqtadee, he will not recite tasmee, but he will recite tahmeed in the position of qaumah. Hence, according to these two Imaams (rahimahumallah), the imaam and muqtadee will both recite tahmeed at the same time in the posture of qaumah. In this way, the muqtadee will not precede the imaam in reciting tahmeed.

 

The Proof of Imaam Abu Yusuf (rahimahullah) and Imaam Muhammed (rahimahullah)

The proof of the two students of Imaam Abu Hanifah (rahimahullah), Imaam Abu Yusuf (rahimahullah) and Imaam Muhammed (rahimahullah), is the Hadith of Hazrat Abu Hurairah (radhiyallahu ‘anhu):

ثم يقول سمع الله لمن حمده حين يرفع صلبه من الركعة ثم يقول وهو قائم ربنا لك الحمد (صحيح البخاري، الرقم: 789)

From this Hadith, they prove that the imaam will recite both tasmee and tahmeed. He will recite tasmee while rising from ruku and tahmeed in the posture of qaumah. As far as the muqtadee is concerned, he will recite tahmeed at the time the imaam recites tahmeed.

 

The response of Imaam Abu Hanifah (rahimahullah) to the proof of Imaam Abu Yusuf (rahimahullah) and Imaam Muhammed (rahimahullah)

The jurists who prefer the opinion of Imaam Abu Hanifah (rahimahullah) explain that the Hadith of Hazrat Abu Hurairah (radhiyallahu ‘anhu) is in reference to a munfarid (one performing salaah alone) and not the imaam.[2]

 

The Eight Mutoon Kitaabs

When we examine the ibaaraat (texts) of the Fuqahaa, we find that the fatwa is based on the Mazhab of Imaam Abu Hanifah (rahimahullah). Below we will present the ibaaraat of the eight mutoon kitaabs [3] which show that the Mazhab of Imaam Abu Hanifah (rahimahullah) is the preferred Mazhab:

1. The quotation of Al-Wiqaayah

ثم يسمع رافعا رأسه ويكتفى به الامام وبالتحميد المؤتم (الوقاية صـ 146)

2. The quotation of An-Nuqaayah

ثم يسمع رافعا رأسه ويكتفى به الامام وبالتحميد المؤتم (النقاية صـ 255)

3. The quotation of Mukhtasar Al-Qudoori

ثم يرفع رأسه ويقول سمع الله لمن حمده ويقول المؤتم ربنا لك الحمد (مختصر القدوري صـ 72)

4. The quotation of Majmaul Bahrain

ثم يقوم ويقول سمع الله لمن حمده والإمام يكتفي به ويقول المؤتم ربنا لك الحمد ونمنعه عن الجمع بينهما ويجمع المنفرد في الأصح (مجمع البحرين وملتقى النيرين صـ 123)

5. The quotation of Hidaayah

ثم يرفع رأسه ويقول سمع الله لمن حمده ويقول المؤتم ربنا لك الحمد ولا يقولها الإمام عند أبي حنيفة رحمه الله تعالى وقالا يقولها في نفسه لما روى أبو هريرة رضي الله عنه أن النبي عليه الصلاة والسلام كان يجمع بين الذكرين ولأنه حرض غيره فلا ينسى نفسه لأبي حنيفة رحمه الله تعالى قوله عليه الصلاة والسلام  إذا قال الإمام سمع الله لمن حمده فقولوا ربنا لك الحمد هذه قسمة وإنها تنافي الشركة ولهذا لا يأتي المؤتم بالتسميع عندنا خلافا للشافعي رحمه الله تعالى ولأنه يقع تحميده بعد تحميد المقتدي وهو خلاف موضوع الإمامة وما رواه محمول على حالة الانفراد والمنفرد يجمع بينهما في الأصح وإن كان يروى الاكتفاء بالتسميع ويروى بالتحميد والإمام بالدلالة عليه آت به معنى (الهداية 1/ 50)

6. The quotation of Multaqal Abhur

ثم يرفع الإمام قائلا سمع الله لمن حمده ويكتفي به وقالا يضم إليه ربنا لك الحمد ويكتفي المقتدي بالتحميد اتفاقا والمنفرد يجمع بينهما في الأصح وقيل كالمقتدي (ملتقى الأبحر صـ 145)

7. The quotation of Kanzud Daqaaiq

ثم رفع رأسه واكتفى الإمام بالتسميع والمؤتم والمنفرد بالتّحميد (كنز الدقائق صـ 163)

8. The quotation of Al-Mukhtaar

ثم يرفع راسه ويقول سمع الله لمن حمده ويقول المؤتم ربنا لك الحمد (المختار1/51)

From all these abovementioned ibaaraat, we see that six of the أصحابِ متون  did not mention the mazhab of Imaam Abu Yusuf (rahimahullah) and Imaam Muhammed (rahimahullah) and sufficed on mentioning the Mazhab of Imaam Abu Hanifah (rahimahullah). This is an indication of them preferring the mazhab of Imaam Abu Hanifah (rahimahullah).

Only two of the أصحابِ متون (the author of Hidaayah and the author of Multaqal Abhur) mentioned the mazhab of Imaam Abu Yusuf (rahimahullah) and Imaam Muhammed (rahimahullah) after mentioning the mazhab of Imaam Abu Hanifah (rahimahullah). However, both the author of Hidaayah and the author of Multaqal Abhur have given preference to the Mazhab of Imaam Abu Hanifah (rahimahullah).

Allaamah Shaami (rahimahullah) has clearly stated in Rasmul Mufti that when the author of Hidaayah presents multiple views with their proofs, then by him mentioning a view last with its proof (responding to all the other proofs), it is an indication of that view being his preferred view. In this mas’alah, the author of Hidaayah has preferred the view of Imaam Abu Hanifah (rahimahullah).

Similarly, Allaamah Shaami (rahimahullah) has explained that the style of the author of Multaqal Abhur is that by him mentioning a view first, before other views, he is indicating to that view being his preferred view. In this mas’alah, he mentioned the view of Imaam Abu Hanifah (rahimahullah) first.[4]

Below we will present ibaaraat from other Hanafi kitaabs which also indicate that the preferred view is the view of Imaam Abu Hanifah (rahimahullah). The indication to show that the authors of the following Kitaabs preferred the view of Imaam Abu Hanifah (rahimahullah) is that after discussing both views, they concluded the discussion by presenting the proof of Imaam Abu Hanifah (rahimahullah) with his response to the proofs of Saahibayn (rahimahumallah). This has been explained by Allaamah Shaami (rahimahullah) in Rasmul Mufti.

1. The quotation of Badaai-us-Sanaai’

فإذا قال الإمام مقارنا للانتقال سمع الله لمن حمده يقول المقتدي مقارنا له ربنا لك الحمد (بدائع الصنائع 1/209)

2. The quotation of Mabsoot of Allamah Sarakhsi (rahimahullah)

ثم (يقول سمع الله لمن حمده ويقول من خلفه ربنا لك الحمد) ولم يقلها الإمام في قول أبي حنيفة  رحمه الله تعالى ويقولها في قول أبي يوسف ومحمد رحمهما الله لحديث عائشة رضي الله تعالى عنها  أن النبي صلى الله عليه وسلم كان إذا رفع رأسه من الركوع قال سمع الله لمن حمده ربنا لك الحمد وعن علي رضي الله عنه قال ثلاث يخفيهن الإمام وقال ابن مسعود رضي الله عنه أربع يخفيهن الإمام وفي جملته ربنا لك الحمد ولأنا لا نجد شيئا من أذكار الصلاة يأتي به المقتدي دون الإمام فقد يختص الإمام ببعض الأذكار كالقراءة ولأبي حنيفة رحمه الله قول النبي صلى الله عليه وسلم وإذا قال الإمام سمع الله لمن حمده فقولوا ربنا لك الحمد فقسم هذين الذكرين بين الإمام والمقتدي ومطلق القسمة يقتضي أن لا يشارك كل واحد منهما صاحبه في قسمه ولأن المقتدي يقول ربنا لك الحمد عند قول الإمام سمع الله لمن حمده فلو قال الإمام ذلك لكانت مقالته بعد مقالة المقتدي وهذا خلاف موضوع الإمامة (المبسوط للسرخسي 1/20)

3. The quotation of Al-Inaayah

وقوله (ولهذا) أي ولأن القسمة تنافي الشركة (لا يأتي المؤتم بالتسميع عندنا خلافا للشافعي ولأنه يقع تحميده) أي تحميد الإمام (بعد تحميد المقتدي) لأن المقتدي يأتي بالتحميد حين يقول الإمام التسميع فلا جرم يقع تحميده بعد تحميد المقتدي (وهو خلاف موضوع الإمامة) وقوله (والذي رواه) يعني أبا هريرة أنه صلى الله عليه وسلم  كان يجمع بين الذكرين فهو (محمول على حالة الانفراد والمنفرد يجمع بين الذكرين في الأصح) وقوله في الأصح احتراز عن القولين الآخرين المذكورين بعده أحدهما الاكتفاء بالتسميع والآخر الاكتفاء بالتحميد (العناية 1/299)

4. The quotation of Al-Jawharatun Nayyirah

(قوله: ويقول المؤتم ربنا لك الحمد) وفي مذهب أحمد ربنا ولك الحمد ولا يقولها الإمام عند أبي حنيفة وعندهما يقولها سرا بعد أن يقول سمع الله لمن حمده لأنه حرض غيره فلا ينسى نفسه يعني لما قال سمع الله لمن حمده صار محثا على التحميد فكان عليه الامتثال فيأتي به مع التسميع كالمنفرد قلنا المنفرد لما حث عليه ولم يكن معه من يمتثل تعين عليه الامتثال له قوله عليه السلام إذا قال الإمام سمع الله لمن حمده فقولوا ربنا لك الحمد وهذه قسمة والقسمة تنافي الشركة ولهذا لا يأتي المؤتم بالتسميع ولأنه لو كان الإمام يقولها لوقع تحميده بعد تحميد المأموم وهذا خلاف موضوع الإمامة وأما المنفرد فإنه يجمع بينهما على الأصح كذا في الهداية (الجوهرة النيرة على مختصر القدوري 1/53)

5. The quotation of Sharh Mukhtasar Tahaawi of Allaamah Jassaas (rahimahullah)

قال أبو جعفر (وإن كان إماما لم يقلها في قول أبي حنيفة ويقولها في قول أبي يوسف ومحمد) قال أبو بكر وجه قول أبي حنيفة ان قوله ربنا لك الحمد جعله النبي صلى الله عليه وسلم أمارة للرفع أبدًا  ألا ترى أن المأموم يقولها في حال الرفع ومعلوم أن قوله سمع الله لمن حمده يستغرق حال الرفع فيحصل قوله ربنا لك الحمد في حال القيام وذلك في غير موضعه كما لا يسبح بعد رفع الرأس من الركوع ولا يفعل تكبير الركوع بعد الركوع ولا بعد رفع رأسه منه لأن هذه كلها إذا كانت مسنونة في موضع متى فاتت عن مواضعها لم تقض (شرح مختصر الطحاوي للجصاص 1/614)

6. The quotation of Ghunyatul Mutamalli

فإن الإمام يقولها ولم يرد ههنا مثله على أن ههنا مانعا ليس هناك وهو أن المسنون في هذه الأذكار إبتداؤها عند إبتداء إنتقالات وإنتهاؤها عند إنتهائه ومقتضاه إنتهاء تسميع الإمام عند انتهاء الرفع وكذا انتهاء تحميد المقتدي فلو حمد الامام بعد ذالك لوقع تحميده بعد تحميد المقتدي وهو خلاف موضوع الامامة (غنية المتملي صـ 319)

7. The quotation of Jaami Al-Rumooz

(و) يكتفي (بالتحميد) أللهم ربنا لك الحمد أو ربنا لك الحمد أو ربنا ولك الحمد أو ربنا استجب ولك الحمد أو أللهم ربنا ولك الحمد والأول أفضل كما فى المحيط  والثاني المشهور فى كتب الحديث كما فى الكرمانى وهو الصحيح كما فى القنية ويقول ذالك عند تسميع الامام (المؤتم) فلا يجمع بينهما بلا خلاف (جامع الرموز للقهستاني 1/154)

8. The quotation of Al-Muheet Al-Burhaani

والمعنى في المسألة لأبي حنيفة أن الإمام لو أتى بالتحميد يقع تحميده بعد تحميد المقتدي وأذكار الصلاة ما ثبتت على هذا فإن ما يشترك فيه الإمام والمقتدي إما أن يأتيا به معا أو يأتي به الإمام أو لا فأما أن يأتي به المقتدي أولا فلا أصل له (المحيط البرهاني في الفقه النعماني 1/362)

9. The quotation of Al-Lubaab

(ثم يرفع رأسه ويقول) مع الرفع (سمع الله لمن حمده) ويكتفي به الإمام عند الإمام وعند الإمامين يضم التحميد سرا هداية وهو رواية عن الإمام أيضا وإليه مال الفضلي والطحاوي وجماعة من المأخرين معراج عن الظهيرية ومشى عليه في نور الإيضاح لكن المتون على خلافه (اللباب في شرح الكتاب 1/69)

10. The quotation of Raddul Muhtaar

(قوله وقالا يضم التحميد) هو رواية عن الإمام أيضا وإليه مال الفضلي والطحاوي وجماعة من المتأخرين معراج عن الظهيرية واختاره في الحاوي القدسي ومشى عليه في نور الإيضاح  لكن المتون على قول الإمام (رد المحتار 1/497)

11. The quotation of Tabyeenul Haqaaiq

(واكتفى الإمام بالتسميع والمؤتم والمنفرد بالتحميد) وقال أبو يوسف ومحمد يجمع الإمامين الذكرين لحديث أبي هريرة رضي الله عنه أنه عليه الصلاة والسلام كان يجمع بينهما ولأنه حرض غيره فلا ينسى نفسه وقال الشافعي رحمه الله يأتي الإمام والمأموم بالذكرين لأن المؤتم يتابع الإمام فيما يفعل ولنا ما روى أبو هريرة وأنس بن مالك أنه صلى الله عليه وسلم قال إذا قال الإمام سمع الله لمن حمده فقولوا ربنا لك الحمد رواه البخاري ومسلم قسم بينهما والقسمة تنافي الشركة ولا يلزمنا قوله عليه الصلاة والسلام إذا قال الإمام ولا الضالين فقولوا آمين حيث يؤمن الإمام مع القسمة لأنا نقول عرف ذلك من خارج وهو قوله عليه الصلاة والسلام فإن الإمام يقولها وقوله عليه الصلاة والسلام إذا أمن الإمام فأمنوا فإن قيل قد روي عن ابن مسعود رضي الله عنه أنه قال أربع يخفيهن الإمام وقد عد منها التحميد فقد عرف التحميد أيضا من خارج فوجب أنه لا يأتي به قلنا ما رويناه من حديث القسمة مرفوع وحديث ابن مسعود موقوف عليه فلا يعارض المرفوع وما ذكره الشافعي بعيد لأن الإمام يحث من خلفه على التحميد فلا معنى لمقابلة القوم له على الحث بل يشتغلون بالتحميد لا غير لأن اللائق للمحرض أن يأتي بالإجابة طاعة دون الإعادة لأنها تشبه المحاكاة وما روياه محمول على حالة الانفراد (تبيين الحقائق 1/115-116)

12. The quotation of Al-Bahrur Raaiq

(قوله واكتفى الإمام بالتسميع والمؤتم والمنفرد بالتحميد) لحديث الصحيحين إذا قال الإمام سمع الله لمن حمده فقولوا ربنا لك الحمد فقسم بينهما والقسمة تنافي الشركة فكان حجة على أبي يوسف ومحمد القائلين بأن الإمام يجمع بينهما استدلالا بأنه عليه السلام كان يجمع بينهما لأن القول مقدم على الفعل وحجة على الشافعي في قوله إن المقتدي يجمع بين الذكرين أيضا وحكاه الأقطع رواية عن أبي حنيفة وهو غريب فإن صاحب الذخيرة نقل أنه لا يأتي بالتسميع بلا خلاف بين أصحابنا (البحر الرائق 1/334)

13. The quotation of Fataawa Hindiyyah

فإن كان إماما يقول سمع الله لمن حمده بالإجماع وإن كان مقتديا يأتي بالتحميد ولا يأتي بالتسميع بلا خلاف (الفتاوى الهندية 1/74)

It should be borne in mind that though the preferred opinion in the Hanafi Mazhab is the opinion of Imaam Abu Hanifah (rahimahullah), certain Hanafi jurists have preferred the view of Imaam Abu Yusuf (rahimahullah) and Imaam Muhammed (rahimahullah) (which is also one view reported from Imaam Abu Hanifah (rahimahullah)). Among these Fuqahaa are the following:

  1. Imaam Tahaawi (rahimahullah)
  2. Allaamah Fadhli (rahimahullah)
  3. Shamsul A’immah Halwaani (rahimahullah)
  4. The author of al-Haawi al-Qudsi, Allaamah Ghaznawi (rahimahullah)
  5. The author of Kaafi (rahimahullah)
  6. The author of Fataawa Taatarkhaaniyah (rahimahullah)
  7. Allaamah Ibnul Humaam (rahimahullah)
  8. Allaamah Shurumbulaali (rahimahullah)

NB: From the writings of Allaamah Ibnul Humaam (rahimahullah), we understand that he is inclined to the view of Saahibayn (rahimahumallah). Similarly, the author of Fataawa Taatarkhaaniyah (rahimahullah) concluded the discussion of this mas’alah by quoting the view of Saahibayn (rahimahumallah) and those who have preferred the view of Saahibayn (rahimahumallah), thereby showing his inclination to their view.

إما أن يكون المصلى إماما أو مقتديا أو منفردا فإن كان إماما يقول سمع الله لمن حمده بالاجماع وهل يقول ربنا لك الحمد على قول أبي حنيفة لايقول وعلى قولهما يقول وفي الكافي يقول سرا  م: وقال الإمام شمس الأئمة الحلوانی رحمه الله كان شيخنا القاضي الإمام يحكي عن أستاذه أنه كان يميل إلى قولهما وكان يجمع بين التسميع والتحميد حين كان إماما والطحاوی رحمه الله كان يختار قولهما أيضا وهكذا نقل عن الجماعة من المتأخرين رحمهم الله أنهم اختاروا قولهما وهو قول أهل المدينة وفي شرح الطحاوی وهو قول الشافعي (الفتاوى التاتارخانية 2/169)


2. The quotation of Allaamah Ibnul Humaam (rahimahullah)

ثم الإرسال في القومة بناء على الضابط المذكور يقتضي أن ليس فيها ذكر مسنون وإنما يتم إذا قيل بأن التحميد والتسميع ليس سنة فيها بل في نفس الانتقال إليها لكنه خلاف ظاهر النصوص والواقع أنه قلما يقع التسميع إلا في القيام حالة الجمع بينهما (فتح القدير 1/288)


3. The quotation of the author of Al-Lubaab, Allaamah Maydaani (rahimahullah)

(ثم يرفع رأسه ويقول) مع الرفع (سمع الله لمن حمده) ويكتفي به الإمام عند الإمام وعند الإمامين يضم التحميد سرا هداية وهو رواية عن الإمام أيضا وإليه مال الفضلي والطحاوي وجماعة من المأخرين معراج عن الظهيرية ومشى عليه في نور الإيضاح لكن المتون على خلافه (اللباب في شرح الكتاب 1/69)

4. The quotation of the author of Al-Haawi Al-Qudsi, Allaamah Ghaznawi (rahimahullah)

والمقتدي يقول ربنا لك الحمد والمنفرد يجمع بين الذكرين إن شاء والإمام لا يزيد على الأول وقالا يجمع بينهما وبه نأخذ ويخفي الثاني (الحاوي القدسي 1/168)

5. The quotation of Alaamah Shurumbulaali (rahimahullah)

ثم رفع رأسه واطمأن قائلا سمع الله لمن حمده ربنا لك الحمد لو أماما أو منفردا والمقتدي يكتفي بالتحميد (نور الإيضاح صـ 60)

(قوله وقالا يضم التحميد) هو رواية عن الإمام أيضا وإليه مال الفضلي والطحاوي وجماعة من المتأخرين معراج عن الظهيرية واختاره في الحاوي القدسي ومشى عليه في نور الإيضاح  لكن المتون على قول الإمام (رد المحتار 1/497)

 

Conclusion:

From the above discussion, we conclude that both opinions have been preferred in the Hanafi Mazhab by the various Hanafi Fuqahaa. However, from the two views, the view that most of the Hanafi Fuqahaa have preferred, and which conforms to the mutoon, is the view of Imaam Abu Hanifah (rahimahullah). Nevertheless, since a large group of Hanafi jurists have preferred the opinion of the two students of Imaam Abu Hanifah (rahimahullah), Imaam Abu Yusuf and Imaam Muhammed (rahimahumallah), practicing on either view is permissible and will conform to the Sunnah.

 

Should the munfarid recite tasmee and tahmeed?

Q:  Should the munfarid recite tasmee and tahmeed or only tahmeed?

A: There are three opinions in the Hanafi Mazhab in regard to whether the munfarid should recite tasmee and tahmeed.

  1. The first opinion is that the munfarid will only recite tasmee.
  2. The second opinion is that the munfarid will only recite tahmeed.
  3. The third opinion is that the munfarid will recite both.

Allaamah Shaami (rahimahullah) has mentioned that there is tasheeh in the mazhab on all the above three opinions. However, the third opinion is the most preferred opinion. Hence, the third opinion will be practised upon in the Hanafi Mazhab.

(و) يكتفي (بالتحميد المؤتم) وأفضله: اللهم ربنا ولك الحمد، ثم حذف الواو، ثم حذف اللهم فقط (ويجمع بينهما لو منفردا) على المعتمد يسمع رافعا ويحمد مستويا (ويقوم مستويا)
قال العلامة ابن عابدين – رحمه الله - : (قوله على المعتمد) أي من أقوال ثلاثة مصححة. قال في الخزائن: وهو الأصح كما في الهداية والمجمع والملتقى وصحح في المبسوط أنه كالمؤتم وصحح في السراج معزيا لشيخ الإسلام أنه كالإمام. قال الباقاني: والمعتمد الأول اهـ. (رد المحتار 1/497)

[1] ربنا لك الحمد اذا استوى قائما وهو على القوم والامام جميعا في قول أبي يوسف ومحمد وليس ذلك على الامام في قول أبي حنيفة (النتف في الفتاوى 1/63)

[3] ثم لا يخفى أن المراد بالمتون المتون المعتبرة كالبداية ومختصر القدوري والمختار والنقاية والوقاية والكنز والملتقى فإنها الموضوعة لنقل المذهب مما هو ظاهر الرواية بخلاف متن الغرر لمنلا خسرو ومتن التنوير للتمرتاشي الغزي فإن فيهما كثيرا من مسائل الفتاوى (رسم المفتي صــ 98)

طبقة المقلدين القادرين على التمييز بين الأقوى والقوي والضعيف وظاهر الرواية وظاهر المذهب والرواية النادرة كأصحاب المتون المعتبرة كصاحب الكنز وصاحب المختار وصاحب الوقاية وصاحب المجمع (رسم المفتي صـ 24)

[4] وكذا صاحب ملتقى الأبحر التزم تقديم القول المعتمد وما عداهما من الكتب التي تذكر فيها الأقوال بأدلتها كالهداية وشروحها وشروح الكنز و کافي النسفي والبدائع وغيرها من الكتب المبسوطة فقد جرت العادة فيها عند حكاية الأقوال أنهم يؤخرون قول الإمام ثم يذكرون دليل كل قول ثم يذكرون دليل الإمام متضمنا للجواب عما استدل به غيره وهذا ترجيح له إلا أن ينصوا على ترجيح غير قال شيخ الإسلام العلامة ابن الشلبي في فتاواه الأصل أن العمل على قول أبي حنيفة ولذا ترجح المشايخ دليله في الأغلب على دليل من خالفه من أصحابه ويجيبون عما استدل به مخالفه وهذا أمارة العمل بقوله وإن لم يصرحوا بالفتوى عليه إذ الترجيح كصريح التصحيح انتهى (شرح عقود رسم المفتي صـ 98-99)
